HR Update - P3

Sunday, January 2, 2011 by Human Resources

lawThe U.S. Department of Labor has launched a new initiative that would require nearly every U.S. business to proactively demonstrate compliance with safety laws, wage laws, and anti-discrimination laws.  This program, known as "Plan/Prevent/Protect" (also known informally as "P-Cubed" or "P3"), results from the fact that the DOL is overwhelmed and understaffed.  Because of this, the DOL has decided to shift some of their policing duties onto the private sector.  Once implemented, P3 will require every entity covered by the FLSA, OSHA, the OFFCP, and MSHA to make written plans ("Plan"), create processes ("Prevent"), and test the processes with designated compliance employees ("Protect").

Management 2000, an Indiana PEO, has experienced HR professionals who keep up to date on current employment laws and trends.  They have the ability to help employers develop effective and legally compliant human resource policies and procedures.  For more information about the human resource management services provided by Management 2000, call (317) 549-2000 or visit www.management2000.com.

HR Best Practices: Non-Compete Agreements

Wednesday, September 15, 2010 by Human Resources

Non-compete agreements are contracts between employers and employees in which employees agree not to compete with their employers following termination. While such agreements can offer employers significant protection, they must be drafted carefully to ensure enforceability:

·        Non-compete agreements should be in writing and signed by the employee;

·        Non-compete agreements should be mutual, including employer obligations to employees as well as employee obligations to employers;

·        Employees should receive some form of consideration in return for signing the agreement;

·        Non-compete agreements should be reasonable in duration and restricted to limited geographical areas; and

·        Non-compete agreements should be narrowly drawn to protect employers' legitimate business interests

The requirements for an enforceable non-compete agreement can vary from state to state.  Management 2000, an Indiana PEO, has the HR management tools necessary to research states’ requirements and help employers develop effective and enforceable non-compete agreements. For more information about all the human resource management services provided by Management 2000’s HR Department, call (317-549-2000 or visit www.management2000.com

HR Best Practices – Employee Classification

Monday, September 13, 2010 by Human Resources

Whether workers should be classified as employees or independent contractors is an important human resources issue and litigation in this area is likely to increase in the future. Recent cases indicate, however, that the courts do not have a uniform approach to the independent contractor analysis. While the National Labor Relations Board consistently applies a 10-factor test of independent contractor status, federal courts disagree on the test to be used or the factors to be emphasized.

As is true with most employment litigation, these cases may take years to resolve and the cost to employers can easily be six figures. Management 2000, a Professional Employer Organization
in Indiana, constantly monitors court cases involving human resources issues.  With this information, the HR professionals in Management 2000’s HR Department can provide guidance and support regarding employee classification as well as other human resource policies and practices. For more information about the many human resource management services provided by Management 2000, call (317-549-2000) or visit www.management2000.com

Human Resources Help - FLSA

Wednesday, September 1, 2010 by Human Resources

Under the Fair Labor Standards Act, “outside sales” employees are exempt from the overtime provisions in the Act.  It would seem reasonable to assume, therefore, that pharmaceutical sales representatives who call on physicians would fall into this exempt category.  The United States Department of Labor, however, disagrees. The Department recently submitted a brief in a 9th Circuit Court of Appeals case arguing that the job of the pharmaceutical sales representatives in that case was to persuade physicians to prescribe the company's products, but they did not "make sales" as required by the Act’s exemption for outside sales employees.

Management 2000, a Professional Employer Organization in Indiana, constantly monitors federal and state laws and regulations as well as other media related to human resources administration. With this information, the HR professionals in Management 2000’s HR Department can provide guidance and support regarding payroll policies as well as other human resource issues.  For more information about the many human resource management services provided by Management 2000, call (317-549-2000 or visit www.management2000.com

Dont Overdo Your Safety Messages

Thursday, August 26, 2010 by SAFETY

Safety reminders and messages generally do improve cultures and outcomes. But there comes a point when efforts might fail to improve- and possibly even harm- safety results. Workers can become frustrated with to many safety procedures and too much information. This is especially true if they are dealing with overwhelming responsibilities or feel to pressured to produce, while also dealing with complicated safety requirements. At that point they may begin to cut corners on on safety, either deliberately or subconsciously. To avoid overwhelming your workers, look for ways to simplify safety. Try to provide the appropriate amount of information in a easy understandable way- neither too little or too much. A good safety program is important and training is critical. Don't let information overload undermine your efforts.
       Always look to your Human Resource Management Service for guidance and HR Procedures along with HR Strategies and HR Management Training to relieve the stress of information overload. Human Resource Consultants are trained in the most effective HR Procedures that you may follow to alleviate the problems of communication you or your safety department may be having.

HR Administration - Employee Debts to Employers

Wednesday, August 11, 2010 by Human Resources

When an employee leaves a company and owes the employer (i.e for uniforms, borrowed vacation or sick time, etc.), what’s an employer to do? Unfortunately, many employers believe they can simply withhold the amount owed from the employee’s final paycheck. In most states, however, that type of withholding can be illegal.

The good new is that the HR professionals at Management 2000, a Professional Employer Organization, can help employers find ways to legally recover money owed them by departing employees. This is but one of the many human resource management services provided by the Human Resource Department at Management 2000.  For more information call (317) 549-2000 or visit www.management2000.com.

Monday, August 2, 2010 by Human Resources

According to a recent WorldatWork survey, employers plan a 2.5 percent average increase in salary budgets next year, with average raises of up to 0.7 percent projected for low performers, 2.4 percent for middle performers, and 3.7 percent for top performers.  Employee compensation is a critical factor in both recruiting and retention strategies.  Appropriate pay rates depend on many factors, including industry averages and other benefits offered by a particular employer.

Learn To Love Public Speaking

Tuesday, July 27, 2010 by SAFETY
Many safety trainers experience stage fright. But you can reduce your fear by changing how you think about public speaking.
  • Recognize the fear and acknowledge it exists. Just admit it to yourself.
  • Reject the fear by making a conscious choice
  • Replace stage fright with "stage delight" that's what executive speaking coach Matthew Cossolotto calls the feeling you get when you shift your focus away from your own self-consciousness. He recommends you pay attention instead to the connection with your audience, the way you would in a one-to-one conversation.
    Working with your Human Resource Management Team will allow you to experience the many HR Strategy's and HR Procedures you can apply directly to your issue. HR Professionals have been trained to deal with such problems as stage fright and apply HR Management Tools and HR Best Practices to your HR Training to allow you to better understand the issues around you. Don't be afraid to ask for your Human Resource Departments help in dealing with this issue.

Human Resources Help – Keeping Emotions out of Human Resources

Monday, July 26, 2010 by Human Resources

Small business owners have a significant monetary and personal investment in their businesses. This can be a tremendous motivation to succeed. However, if owners take issues involving employee conduct personally, problems can arise.  For example, if an employee complains that the owner doesn’t care about his/her employees, the owner may take offense and want to discipline or, even worse, terminate the employee. This type of reaction can lead to litigation such as discrimination charges and unemployment claims.

Having a “buffer” between the owner and employees can help avoid these situations.  Management 2000, an Indiana PEO, acts as an off-site HR Department providing employers with a wide range of human resource management services.  The HR professionals at Management 2000 provide the human resources support employers need to deal with employee issues in an impartial, effective manner.
