Is the Employee Free Choice Act really "free choice"?

I can't help but be confused by the name of The Employee Free Choice Act (EFCA).  With this act, if an organizing union has 50% + 1 signed cards, the union wins - no vote.  If the union and Company are not able to negotiate a contract, the government steps in and mandates the conditions of employment for a 2 yr. period. I guess that's where my confusion is, where is the "free choice" here?  I believe that the Act will not pass the Senate in it's present form, but it will pass at some time in some form. Given President Obama's community organizing background this is an agenda that is near and dear to his heart.  The key to dealing with this act is to ensure that you have created a work environment where employees feel there is no need for a union. Look at your Employee Benefit plans, your compensation plan, work rules and job enrichment. How well are your managers trained?  For small employers  these activities can be daunting. I'm not if you are truly confused or if you are just promoting big business management filth. The reason it is called Employee Free Choice Act is because workers get to CHOOSE if they want to have a secret ballot or majority card check. If the MAJORITY of workers chose to have a union then obviously the employee's choice prevailed. The only people that want a secret ballot is management so then can continue to coerce, bribe, and threaten pro-union works. That means management scum can no longer hire union busters to vandalize workers cars. The EFCA also gives ample time to negotiate a contract. What it doesn't give is the employer the ability to forever stall negotiations. It's a shame someone hates the idea of a strong middle class

Wrong Mr. Mgmt. scum. It's hard for an auto company to do business when their sales plummet 25% in one year. The union workers did their job, as they have done for decades, and built the cars; they guys at the top are the ones that decided to shove SUVs down our throats.Too make things even worse, we have a healthcare system that is a cost inflating disaster for everyone except insurance companies.

The comments made by EFCA just emphasize the problem with this proposed law. This person is under the impression that secret ballot is a choice. THERE IS NO CHOICE. Secret ballot is not an option. If one person more than 50% sign cards, the union is automatic. Employees will be relying on the union organizer to give them that information. Hummm, do you really think a union organizer is going to explain that? If you want to be fair to employees, give ALL of them the right to vote whether they want a union or not. That's what makes a stronger middle class.

First off, its hardly a secret when your employee bullies, threatens and fires pro-union employees before an election. If over 50% of workers want a union then the workers have made their choice clear so there is no need to let management continue a propaganda game! If it is anything less than 50%, a secret ballot election is automatically held. The facts are clear: an employee is far more likely to be bullied by their employer than by the union organizers.
